A Miami-Dade judge has decided to drop the felony charge facing a former cop who is on trial for killing his K-9 companion.
Allen Cockfield faced prison time if convicted of killing a police dog, which is a third degree felony. Cockfield, a 25-year veteran of the Miami-Dade police force, is accused of choking and then kicking Duke the K-9 repeatedly during an obedience training session in 2006.
The two had been partners for six months before the incident happened.
The judge ruled Cockfield didn't intend to kill Duke, despite his violent actions. The former cop still faces animal cruelty charges, which are a misdemeanor and come with possible jail time and a fine.
Testimony from a dog trainer who was present during the incident described the violent nature of Cockfield's actions by kicking the jury box several times loudly to demonstrate the intensity of the blows.
Duke died after repeatedly being kicked in the ribs, which likely caused his heart to skip a beat and resulted in the dog having a seizure.
On Wednesday, another former colleague of Cockfield told the jury he "hated" his four-legged partner.

This K9 was actually a Belgian Malinois...not a German Shepherd. Doesn’t matter though.

We have a German Shep dog that is such a sweetheart. The idea of kicking a dog so hard that you kill him is beyond comprehension. I don’t understand why the other trainers didn’t stop him. This man should never have been allowed near a dog OR the public for that matter. If he did this to a defenseless dog... what has/or would he have done to a citizen? Just a thought
Generally they do not pair an officer with a police dog if they HATE dogs. I say fire this guy, jail him, fire whoever paired him with the dog. Those dogs are great dogs and extremely expensive to train and maintain. He killed a 40,000 dollar-plus piece of living, taxpayer property that he should never have been given any control over.
And no civilian would ever have the felony charge dropped.
Well if they kill their own dogs, then don’t be surprised they kill our dogs...
If this happened during a TRAINING session, this guy has more issues than most criminals....
I say throw the book at him, but I’ll bet there is a mistrial declared. Kicking the jury box is an outrageous stunt that could only be meant to inflame - I can’t believe the judge would have given the prosecutor permission to do that. Wait and see.
