Testimony Sought of “Custodian of Records” AND Production of all records relating to President
Decision to be made by Army Major General
Washington, D.C., July 29, 2010. The Army doctor who is facing a court martial for refusing to obey orders, including a deployment order for his second tour of duty in Afghanistan, has formally requested his Commanding General approve a deposition in Hawaii of the records-keeper of the State Department of Health—and the production of all of their records concerning Barack Obama.
The records Lakin seeks have been the subject of intense interest ever since the closing days of the 2008 presidential campaign when a document appeared on the internet purporting to be a certification that Hawaii’s Dept. of Health had records showing he had been born in Honolulu. Since then, Dr. Chiyome Fukino the head of that agency has made public statements on the subject, but has refused all requests for copies of the actual records in the Department’s custody. Recently, a former Hawaii elections clerk has come forward saying that he was told that the Department’s records showed Obama was NOT born in Hawaii.
The United States Constitution requires that a person be a “natural born citizen” to be elected to the presidency. If Mr. Obama was not born in Honolulu as he has claimed, then he is unlikely to be a “natural born citizen”. An examination of the records kept by the Hawaii Dept. of Health are an essential first step in ascertaining Mr. Obama’s constitutional eligibility to hold the office to which he was elected in 2008.
While no civil litigant has obtained discovery of these records, and all the civil lawsuits seeking those records have been dismissed on procedural grounds, Lakin’s case is different because he is the subject of criminal prosecution, and upon conviction stands in jeopardy of being sentenced to years at hard labor in the penitentiary.
Lakin’s request was submitted by his counsel to the Commanding General of the Military District of Washington, Major General Karl R. Horst, under Rule 702(b) of the Rules for Courts-Martial, which provides that “A convening authority who has the charges for disposition or, after referral, the convening authority or the military judge may order that a deposition be taken on request of a party.”
Lakin’s civilian attorney has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense to LTC Lakin. Obama has never proven in a court of law that he went to Pakistan.
The guidance in the Wong Kim Ark decision says that parents matter. They quote Minor’s definition of natural born citizen that says parents must be citizens, and they go on to say that Ark’s parents mattered in order to make Ark a citizen of the United States because the parents were permanent residents. Ankeny flubbed up by misreading, misundestanding and misinterpreting WKA. Period.

And the name of the parents in the August 13, 1961 “Honolulu Advertiser” birth announcement and the August 14, 1961 “Honolulu Star-Bulliten” birth announcement is “Mr. and Mrs. Barack Hussein Obama” of 6085 Kalanianaole Hwy. Honolulu. They had a son born on August 4th.
But then again, there was a natural born citizen named Leslie Lynch King, Jr. but when he was sworn in as president, his name was Gerald R. Ford.

She didn’t use them interchangably. There’s no need to if the original birth certificate proved Obama was born in Hawaii. And she lied. There’s no vital record that proclaims any person to be a ‘natural-born American citizen.’ And there’s no such legal entity to start with.
Good find. Barack Hussein Obama never lived at 6085 Kalanianaole Hwy, and there’s no place of birth listed in that announcement. At BEST, it proves a birth date and gender.
There is no "Lt." Harris. The identity thief in question was named Leiutenant Quarles Harris, Jr. His first name was "Leiutenant," and thus it's completely wrong (but curiously common among Birthers) to pretend he was an officer.

That is exactly what I am saying. Its a cheap legal conjuring trick.
Also, note that Minor sets up 2 categories: “natives, or natural-born citizens, as distinguished from aliens or foreigners”. That would support Obama being a NBC if born in Hawaii.
You need to read more closely. It says there are DOUBTS about anything BUT children born of parents who are citizens. Keep in mind, this was AFTER the ratification of the 14th amendment. If the only thing that mattered was jus soli birth, the 14th amendment would have made it so and there would be no doubts about children born 'without reference to the citizenship of their parents.' But they don't say that. The only citizens who are natural born without any doubts are those born in the country of parents who are citizens.
And again, the WKA decision specifically mentions that they determined the citizenship of a child whose parents are permanent residents. The parents status mattered.
That was the address of the grandparents. My kids sometimes use my address for reference, since mine doesn’t change much.
You again don’t understand what you are reading. Natives are those born in the country of parents who are citizens. It’s not talking about jus soli birth.

While I think there is camouflage tactics being employed, i.e. multiple prosecutions to hide the real Obama operative link, there is no evidence this was linked to this shooting death.
There’s no question SAD would have used her parents address as permanent address. Barak Sr. did not. That is on record.
Fun fact to add to your account:
The first Republican candidate for President was John Charles Fremont, in 1856. Fremont's mother was a Virginian, but his father was a recent French immigrant. And his parentage was public knowledge. Thus, we see in Fremont a prime example of a Presidential candidate born to a citizen mother and a non-citizen father, even before the 14th Amendment.
Funny how in the 154 years since, it hasn't been alleged that the first Republican candidate for President was actually illegitimate and an attempted French usurper. There must be some difference between Fremont's father and Obama's to make people want to treat them differently...
The director has discretionary authority to release ANY information from a birth record via this part of the statute. According to a staff attorney opinion letter (and the earlier language of 338-18(d)), the index data includes the certificate number. Yet for some reason, when asked for the index data related to the factlack dot org certificate number, the DOH refuses to say that it belongs to Obama or who else it might belong to. Using this one fact, the director of the DOH could legally confirm Obama’s alleged COLB as genuine, but instead, Fukino refuses. They claim that that OTHER unknown vital records allegedly verify Obama was born in Hawaii, but they won’t say that the original birth certificate does (and by default, the alleged COLB).
Further, we’ve learned from the DOH procedures and the Nordyke certificates that the factlack cert number cannot belong to Obama at all. No wonder the DOH uses wordplay to avoid saying Obama’s COLB is legit.
There is a three and four digit difference between the Nordyke Twins’ registration numbers and the Obama number.

Probably easily accounted for by different clerks doing the registering of the Nordykes vs Obaman of children born over a weekend. Obama was born on Friday evening and didn’t get his birth registered until Tuesday, August 8th. Did a registration clerk call in sick on Monday and leave Obama’s birth notice on her/his desk until Tuesday?
Hawaii Directors of Health before Dr. Fukino and probably after she is gone defer to the language in HRS 338-18(b) on who has access and under what circumstances:
“The department shall not permit inspection of public health statistics records, or issue a certified copy of any such record or part thereof, unless it is satisfied that the applicant has a direct and tangible interest in the record. The following persons shall be considered to have a direct and tangible interest in a public health statistics record:
(1) The registrant;
(2) The spouse of the registrant;
(3) A parent of the registrant;
(4) A descendant of the registrant;
(5) A person having a common ancestor with the registrant;
(6) A legal guardian of the registrant;
(7) A person or agency acting on behalf of the registrant;
(8) A personal representative of the registrant’s estate;
(9) A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction;
(10) Adoptive parents who have filed a petition for adoption and who need to determine the death of one or more of the prospective adopted child’s natural or legal parents;
(11) A person who needs to determine the marital status of a former spouse in order to determine the payment of alimony;
(12) A person who needs to determine the death of a nonrelated co-owner of property purchased under a joint tenancy agreement; and
(13) A person who needs a death certificate for the determination of payments under a credit insurance policy.
(c) The department may permit the use [of] the data contained in public health statistical records for research purposes only, but no identifying use thereof shall be made.
(d) Index data consisting of name and sex of the registrant, type of vital event, and such other data as the director may authorize shall be made available to the public.
