Ezra Klein of the Washington Post, the founder of Journolist, quickly jumped in: "Nope, no message coordination. I'm not even sure that would be legal. This is a discussion list, though, and I want it to retain that character," he wrote.

This reads to me as a "nudge, nudge, wink, wink" comment along the lines of "from a legal standpoint I'll have to advise against it, BUT I'm not going to stop you from talking about it (please do!)".

It reminds me of the country cop who said (true story) “You have a gun, right? Of course I would NEVER advise you take the law into your own hands, but if he comes back, well, you know it takes 20 minutes for us to get out here to you...”

Some cops are cool.
