The family of a Wharton firefighter who died battling a massive egg farm blaze is fighting to keep his widow from receiving death benefits, arguing that the 37-year-old had found out his bride of two years was born a man.
Thomas Araguz III separated from his wife after learning her history two months prior to being trapped in the fatal July 3 fire, according to attorney Chad Ellis, who is representing Araguz's parents in the lawsuit.
"He was distraught. It was extremely difficult and embarrassing for Tommy," said Ellis, who added that there is no will for the estate, which will be substantial since the fire captain died in the line of duty.

who did he name on his insurance as his death beneficiary....if it was her/him/it then case closed. he should have gone right in and changed that if he wanted it to go to his parents.

From the article his ex-wife told him. The real question is did he know all along and just feign outrage when the ex started circulating the news to the other firemen? Its real hard to have a secret in most Fire Departments. That and there is no prospect for transfer. Makes me wonder if the Captain found the egg factory fire a excellent opportunity to cash out and cash in all at once?
If “she” was born a man and did not tell this fellow before they wed, then “she” is in violation of the marriage contract and shouldn’t get a thing.

Any chance Nikki was a hermaphodite? He/she has remarkably fine bone structure and the hands seem feminine. Can’t make out the hips, but is it possible this was more a sex assignment rather than a sex change?
Thomas Araguz had been married to Heather Delgado and had two children with her before they divorced in 2008. He married Nikki Araguz later that year. Nikki ran a magazine and ran unsuccessfully for mayor of Wharton while married to Thomas.
According to the newspapers:
The suit says Nikki Araguz legally changed her name Feb. 9, 1996 from Justin Graham Purdue to Nikki Paige Purdue.
The suit includes a copy of the name-change request with the statement, “I, Justin Purdue, am a woman with male anatomy, working toward a sex change. I have been living and working as a woman for over one year and seek to make my new name legal and permanent” included in the filing.
The suit says Texas “courts have held that someone who undergoes a sex change procedure remains as a matter of law, the same sex they were born as.”
Hell, imagine telling your mother that your wife is a he.
