It's not the first time in California. In 2002, Madera Office Marcie Noriega shot Everardo Torres through the heart with a .40 Glock that she thought was a Taser. Torres was handcuffed in the back of a police car. He was trying to kick out the car windows. His BAC was 0.15. Officer Noriega was not charged.

It's not clear how the two cases differ.

A cop not being charged does not mean did not commit a crime. All it means is he wasn’t charged.

Also in 2002, two Oakland PD rookie cops accidentally shot and killed undercover fellow officer Willie Wilkins. The two rookie officers mistook Wilkins for a homeless person who was brawling with someone else in a dark alley in the early morning. When Wilkins reached for his badge, the officers fired their weapons. They were not charged.

The two differ in that white male cop was on video shooting a black man. Perception matters to society even though both persons are dead because someone F-ed up with a gun in their hands.
