The income tax is an excise tax. Constitutionally, excise taxes must be uniform. That means that progressive rates, and rates that differ based on marital status, are Unconstitutional.

16th Amendment:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

Where is the clause about uniformity?
