WHEAT RIDGE, Colo. - Admitted thieves are going free, while an elderly Wheat Ridge man is facing the possibility of spending the rest of his life behind bars, all, he says, for trying to defend his property and his life.
82-year-old Robert Wallace said in February that he looked out his window and saw two men hooking his flatbed trailer up to their pickup. He yelled at them to stop, but they sped away, stealing his trailer. He told police he fired two shots at the pickup.
Minutes later, police say 32-year-old Damacio Torres dropped 28-year-old Alvaro Cardona off at a hospital emergency room with a gunshot wound to the face.

Four counts of attempted first degree murder?! What is wrong with this country that no one has common sense any longer.
There is a repetitive pattern here. Citizen defends life and/or property from foreign invader, reports crime and self defense and is punished. Since our progressive over lords pay no attention to law, why should we continue with the farce? Shoot, shovel and shut-up.
Wallace is the old man whose trailer was stolen not one of the thieves stealing trailers Americans won’t steal.
I can see a case based on unlawful discharge of a firearm perhaps sticking, but not anything more than that as even assault with a deadly weapon requires that intent of assault be proven. There's just way to much space for a defendant-friendly juror to hang their reasonable doubt hats.
The victim should walk.

I doubt a Freeper would get past jury screening if he answered the questions honestly...
They should have just charged Mr. Wallace with “bad marksmanship” or “inadequate ordinance” and let it go at that.

Well, not really minutes. Torres stashed the stolen trailer before he dumped his buddy off at the ER.
Jefferson County. It won’t stand. The DA is a half decent repub. His shop screwed the pooch. Now he has to save face.
The attempted murder charge (and with four counts, no less) is just so beyond the pale. They're trying to bully the defendant into accepting the plea, but ethically speaking, the DA is obligated to not charge unless he believes he can prove his case beyond all reasonable doubt. There's no way a competent prosecutor with any measurable experience would honestly believe that. I'm sure he's no different.
I don’t think any jury will ever convict. Also, there are elderly at risk statutes that the man charged falls under. I don’t know how this happened but Story has a deep hole to backfill.
Exactly. The first move would be to hang the DA in the public square. The next move is to do the same with the two illegal criminals. That should send all the right messages.
That’s coming. Obama wants this to happen, to provoke and make inevitable civil tumult, so that martial law can be declared. Tyrants seize real power this way. You can just see it coming.
