I recall shortly after the Kelo decision a law professor at UNC (or Duke ?) said the NC Constitution didn’t allow for private property to be taken by eminent domain.

Well, the state must have ignored it, because North Carolina has a network of roads, just like any other state.

Perhaps I’m confusing the issue of the state taking property and giving it to a private individual with the eminent domain. My mistake.
