Remember, 4 years ago (approx) the democrats filibustered Estrada because they couldn’t get a release of his old documents from his time in government. They made a “compelling” case to the media and America that you simply couldn’t expect them to vote yes or no if they didn’t have all the facts.
The Republicans should get together, and then issue a statement, which would explain that they still oppose judicial filibusters, but that since the democrats are in the majority, and have set the rules by their own actions, that the republicans will abide by the rules the Democrats used.
Then the republicans should do nothing more but read the transcripts of statements by the democrats, when they speak on the senate floor, or in the sunday talk shows. They should each memorize their parts, and quote the exact things said by the democrats about Estrada and documents.
There should be no vote allowed on Kagan until we have all the documents. That is the standard, that is the Democrat rule, and we should require they abide by that rule, until they themselves issue a Senate rules change to fix it (at which time we can at least know that the democrats won’t be able to pull this crap again when they are in the minority).
