Gibbons health care reform foes will prevail

(AP) — Gov. Jim Gibbons says he is confident a federal judge will deny the Justice Department's motion to dismiss a lawsuit by Nevada and 19 other states challenging President Obama's health care overhaul.

The Republican Gibbons calls it the “Reid/Obama Nationalized Health Care plan,” a reference to Senate Majority Leader Harry Reid. He says the move by Justice Department lawyers suggests the states may have a better chance than some think to win the suit and block the reforms.

If not, Gibbons said Thursday the new program “will crush working families” and burden Nevada taxpayers with $600 million in new costs.

A decision against the states will be irrelevant. Neither the judicial, executive or legislative branches are the government! The people are the government and have the final say as to how they will be governed! Any federal version of health care is unconstitutional since Article 1 Section 8 does not specifically list regulating health care as an enumerated power! This does not require a decision by any court to understand this fundamental concept! The people are not bound by an unconstitutional act!
