They are trying to take over completely from TCEQ but will settle (and Perry will probably cave) for a pound of flesh from the refinery. There's nothing back from Texas since May 26th (see http://www.tceq.state.tx.us/comm_exec/communication/media/) probably because they are diligently trying to follow EPA rules (they resubmit, EPA waits 44.99 days and rejects).
