California: Court rules workers' comp furloughs illegal

About 7,900 state workers' compensation employees were furloughed illegally by Gov. Arnold Schwarzenegger last year and are entitled to $25 million in back pay, a state appeals court ruled Friday.

A state law that exempts employees of the State Compensation Insurance Fund from hiring freezes and staff cutbacks also prohibits Schwarzenegger from cutting their workweeks, said the First District Court of Appeal in San Francisco.

The court endorsed a ruling in March by another appellate panel that found Schwarzenegger acted illegally when he furloughed about 500 lawyers and hearing officers employed by the same insurance fund. Friday's ruling applies to all the fund's employees.

Example of the communists Court that is running the State. We the people and our elected Administration no longer have a voice since the Courts decide what we can or can not do and our voice is null.

just had the experience of shopping around for a new worker’s comp carrier - I get the impression that CA businesses are bailing left and right from the state run insurance. Wonder what they will do when they have no more customers? Hire more workers???

There was a similar ruling here in New York State recently. All these judges are doing is hastening the end of unions as public disgust increase every time this happens.
How is an out of work person,even a lib,supposed to feel when those people are keeping their jobs but being asked to sacrifice while work is so difficult to find overall?

I can't imagine anything more remediatory than unemployed lawyers.
