I'm sure this lowlife lawyer/state rep. will have no problem shopping around for an activist judge who will be eager to agree with him.

I suppose I could read the briefs, but my first question is “Who appointed the judge?” That’s probably the determining factor on a summary judgement, and highlights why the Founding Fathers were concerned about the possibility of judicial despotism.
