Maybe it should be, but it's not. Not under the Constitution anyway.
Article III Section. 3. Treason against the United States shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

ANY foreign power which seeks to abridge the God-given, Constitutionally guaranteed powers of the American public is an enemy to the Republic.
Any Administration which adheres to them, giving them aid and comfort by assisting them to abridge those rights is guilty of TREASON.
