Repelling invasion by a foreign military is authorized by the Constitution. So is responding to a request from the Governor of the State.

You may not remember the military attack on Pastor Koresh and his congregation in Waco. You can google it. Nobody was prosecuted for that.

But performing law enforcement duties at the state or local level is not. Not unless Congress specifically authorizes it.

You may not remember the military attack on Pastor Koresh and his congregation in Waco. You can google it. Nobody was prosecuted for that.

I remember it. That was a BATF operation.
