According the the judge's opinion even that was a private conversation prompted by an undercover agent. The "evidence" for the plan to overthrow the government included video of them burning a UN flag.

So the undercover agent provided the ‘plan’ and induces the Hutaree to ‘the plan’ and maneuvers them by enticing them to make comments to the planned crimes.
