Mary Richardson Kennedy, 50, was arrested Saturday when police determined her blood alcohol level to be .011. The legal limit in New York state is .008.

Actually, the legal limit in NY is .08. I imagine that her BAC was actually .11 which would be illegal in any state rather than .011 which would be legal.

Why can't they get the facts straight?

Actually, the new and almost unknown NY limit is 0.05 with higher penalties at 0.08. You still can go to jail for several days until the legal circus catches up.

0.05 is 1-3 drinks depending on size and alcohol content. I know a small older woman that spent 3 nights in jail for a large glass of wine after dinner.

At this point they should stop playing games and not allow any alcohol while driving. The current system makes people guess and (most importantly) generates revenue from those that think they're safe with 1-2 drinks.
