According to the disciplinary referral, she would be separated from other students during lunch and recess through Friday.

According to the Texas Department of Agriculture’s website, “The Texas Public School Nutrition Policy (TPSNP) explicitly states that it does not restrict what foods or beverages parents may provide for their own children's consumption.”

Ooooo, evil idea. Since she will probably be supervised by some teacher for her lunch & recess detention and there state policy explicitly allows anything the parent gives to the child, I suggest that Tuesday's lunch should be a big bag full of Jolly Ranchers. A few of each flavor. Eat them slowly and tauntingly in front of the teacher supervising her lunch. Just rub it in that the teacher has to supervise her for eating a Jolly Rancher, but there is absolutely nothing he/she can do about this bag full of them.
