Strange.

Your exact same criteria would also make the absurd exclusion of Federalist Papers co-author John Jay from the founders as well, seeing as he did not attend the Philadelphia Convention even though he played a similar role to New York ratification that Marshall did to Virginia.

I first stated some time ago that your argument against Marshall is strictly an argument of convenience to get around the obstacle of Baron v. Baltimore. Everything you have done since that time has only validated my original observation.
