Felony conviction is not an absolute bar to practicing law. Hit the kid again, harder. Try him on the count that resulted in a mistrial.

As for punishment, I predict a fine, restricted movement ("incarcerate" at home or similar), and community service. I don't object to not locking him up - he's not a threat to others, and I suspect he is sufficiently deterred already.

No doubt he can do the “community service” working for ACORN. Barack can always pardon him—whether he would do so as early as this Christmas (in the traditional pardon-granting period) or wait until after the 2012 election depends on whether he thinks there would be some political harm to himself. Not that he should really care about this kid.
