I believe the author has inaccurately stated Ginsburg's opinion on the issue:

Supreme Court Justice Ginsburg says her grandson born in Paris is a “natural born” citizen

My grandson was born in Paris of U.S. citizen parents. I had never considered him a naturalized citizen of the United States.

I'm also not convinced that Justice Thomas' mentioned statement is an absolute reference to this issue

If convicted, yes. He understood the risk. If we are to be a nation of laws, then the sentence must be carried out.

And yes, I believe Obama is a usurping turd that’s undeserving of a toilet. My hope is that all goes well in this instance, but if it doesn’t, the decision must be respected.

LTC Lakin’s problem is that they can simply charge him with what they’ve charged — failure to obey a lawful order — and never need to give him access to the information he hoped would be revealed in order for him to conduct his defense.

The “why” he disobeyed is a moot point. They’ll simply focus on whether or not he obeyed....or indicated that he would not obey.

I feared this from the very beginning and someplace on FR is a post saying as much.

As with all deployment orders, his came through the CJCS, a duly appointed officer in charge of the US military. He can’t even point to the president’s name on those orders. Therefore, he’s standing in opposition to a superior officer appointed by CONGRESS, in an overseas operation approved by Congress, and Congress has the constitutional power to regulate the military, not the president.

I believe he made a tactical error, and now the issue is how to get out of it.

His safest course now that the deck is stacked against him is to claim duress due to combat fatigue/deployment stress and agree to obey the orders. His gambit failed.

We need to have this good man out of the military and preserved for another fight on another day.

If they (correctly) filed a Consular Report of Birth for the kid born in France, then yes, he’s a US citizen at birth.

I doubt he’ll get prison time. He’ll be released from the service, lose his pension and his benefits, but I don’t think he’ll see the inside of Leavenworth.

He has been reassigned to Walter Reed Army Medical Center but stripped of the right to practice medicine.

He was assigned to Walter Reed to begin with. The Pentagon clinic where he was serving is part of Walter Reed. This would have been an administrative shuffling within the unit.

Since his Pentagon pass was pulled, he could hardly go there anymore.

No one has a right to practice medicine, least of all an Army office under charges. But it wouldn't have hurt to keep him seeing patients. What was he going to do? Incite a mutiny?

At least they don't seem to have incarcerated him, nor confined him to his quarters. I take that as a Good Sign.

Yes, it's just one of the obviously false statements resonating in the birther echo chamber. Although easily refuted, expect it to continue to turn up in birther arguments and articles.

Absolutely!

not only that but when obama’s thugs starting putting other people who oppose them,[to wit] Tea Party members, legitamate gun ownes, etal, members of this forum will cheer them on. Why? obama’s thugs will say, “They were plotting to kill law enforcement officers.” That obama’s thugs are lying and making things up will never cross their minds.
