Curious: what exactly does "second-degree and third-degree rape" mean? Second and third degree rape are charged for things like "statutory rape." First degree involves forcible rape.
Probably the Professor admitted to having sex with the girl when she was under-aged but denied it was forcible. So the cops charged what they had the most evidence to convict on. After all, she either was or wasn't underaged.
