That article with Phil Boerner as the source and owner of the photo bears a publishing date one day later than the article where the photos is cropped in the A/P article.

Look at the cropped photo. Look at the couch and the rug where it’s blurry where the Paki would have been. There is an easy way for anyone that thinks the picture is a fake to find out. Ask Boerner. He took the photos, he provided them. He’s not hard to find. :)

This combo photo shows Phil Boerner, right, and his college roommate, Barack Obama, in their New York City apartment in the early 1980s. Boerner took the photo of Obama and Obama took Boerner's photo.
If the AP is suggesting they own or co-own the photo, why wouldn't the NYT needed to have mentioned AP?
And depending when Columbia College Today released their Jan/Feb 2009 issue (i.e., early Jan or Dec, possibly, because latest obit is Dec 1, 2008), Cowen could have picked up the idea to interview Boerner from that issue (article includes the cropped photos).
I am surprised no one has just asked Phil Boerner about the photo.
