NS thinks he has a crystal ball. If Lakin doesn’t get satisfaction in the military justice system, he will have standing to file a suit for wrongful dismissal against Obama and the government.

Lakin will have standing because you say he does? Now who has they crystal ball? Well, let's make sure the judiciary is aware that Red Steel has spoken and has rewritten the definition of standing for them.

You hope the civil courts will protect Obama’s backside as he is tooooooooo big to fail. Those days are rapidly coming to an end for the usurper. I’ve already proved you wrong once in the last 24 hours. We will just have to wait and see...again.

From the Military.com article published 4/9:

Phil Cave, a retired Navy judge advocate general who now practices military law as a civilian, said that even if Lakin does decide to deploy as scheduled, the Army still may be able to prosecute him. Under Article 88, Cave said, a servicemember can be charged for making disrespectful comments or remarks about the president.

Cave believes that Lakin’s supporters in the birther movement hope that a court-martial will give defense attorneys the authority to seek, through discovery, other documents to help make their case.

“They think that by using [servicemembers in a court-martial] they can get discovery like you could in any criminal prosecution,” he said. “That ain’t gonna happen. They’re not going to have discovery where they’re going to get the president to produce a birth certificate because, I’m reasonably certain, no military judge, no appellate court and no federal court, and no U.S. Supreme Court is going to say they have a right to get that as a matter of discovery.”

In a court-martial, the defendant has basically the same evidentiary rights, and the right to discovery, as someone in a civilian criminal trial.

The military judge will have two decisions to make in regard to the Obama BC. First, he will have to make a ruling on whether LTC Lakin can obtain the BC....then, there will have to be an additional ruling on whether Lakin can use it as evidence during his trial

The judge risks having the case overturned on appeal if he rules that Lakin cannot get the real Obama BC...or rules that he cannot use it. Since Lakin’s defense is based on Obama not being a legitimate CIC....any conviction would more than likely be overturned....

The Army will do everything possible not to Court-martial Lakin....but I believe Lakin will turn down all forms of Non-judicial punishment.
