But unlike every other case decided to date, it would seem that this officer actually has an indisputable standing to sue. The harm to him of Obama’s ineligibility is not hypothetical, but neither does it apply to 300 million Americans. I myself may not be brave enough to risk a career in this fashion, but I think a man who does should be commended rather than criticized. That said, I’m no legal beagle, so I don’t know how strong a case he really has.
Then what is? Courts have thrown out many lawsuits on "standing". At least if they send him to a Court Martial, there would be no question of standing. He'd at least get a chance to argue that the orders are illegal, and why. Doesn't mean he'd get "discovery", but it might not be required, depending on his arguement.
