Why? The Electoral College votes on both president and vice-president. Even if Obama was found to be ineligible that doesn't mean Biden was.
Under the original rules for the Presidential election, the Vice-President was the runner-up. Those rules are different now and would need studying.
But if Obama was not eligible on the date when a new administration was to take office, then my guess is that George W. Bush would still be President until such time as a replacement can be elected and take office.
I think there are plenty of complications to consider.
Even if Obama was found to be ineligible that doesn't mean Biden was. For once, we agree. Biden should be president under the Constitution. But ... on whose coattails would Biden ascend to the presidency? Also, under this concept, who's been signing as (the defacto) POTUS? An invalid signature denotes an invalid contract. If in the end Corruption and Deception were involved, laws would likely become invalid. And evidence is OVERWHELMING that Obama is FULLY capable of Corruption and Deception ... |
Read the amendments, (12 and 20). They say if a President shall not have qualified, then the VP shall *act* as President until a President shall have qualified. It's not the same situation as when a President dies or is impeached and removed from office.
