It is the hight of arrogance for them to shove this plan down the throats of all Americans, and then turn around and exempt themselves from having to participate! What a bunch of crap!

The answer is that the penalty for not having insurance is administered through the tax return.
Weiner’s statement that the government is not criminalizing failure to pay the penalty and the government will not come after someone for not paying it is grossly misleading.
As I understand it, there is language in ObamaCare saying the government cannot obtain a lien on your house and denies them certain other remedies to enforce the penalty.
But that provision is really a smokescreen.
The government will already have your money through withholding taxes and estimated tax payments. THAT is how they plan to enforce it. If you truthfully state on your tax return that you have no insurance and you do not include the penalty in computing your return, the government will deduct it from your withholding or estimated tax payments, and reduce your refund. If you owe tax, it will be added to the amount you owe and failure to pay will accrue further penalties and interest.
I believe the reason the liberals didn’t explicitly criminalize this particular provision is that they didn’t need to. The tax code already has enforcement provisions, and it wasn’t necessary to add anything to enforcement the ObamaCare penalty.
For example, if someone lies on their return and says they have insurance but they don’t, there are already laws on the books about lying on your return and the remedies therefore.
And monetary amounts are fungible - purporting to isolate one line item on the tax return and apply different enforcement remedies to that item from the other items on the return would be impracticable in any event.

Face it. We no longer have a system of limited government. If you belong to the producing class our government now decides how much of what you produce or own you get to keep. If you are of the dependent class, the government decides how you get to have of the wealth and income taken from the producing class. All of these decisions are political and you can improve your distribution or reduce the “take” by which ethnic, social, and income group you belong to. For example if you are a union member you will not be taxed for your Cadillac health plan but if you are a non-union worker who has an excellent health plan you will be taxed. If you earn over a certain amount, you will be charged extra medicare taxes on your investment savings and you will not be entitled to the same deductions as other “citizens”. If you choose not to work and breed children you cannot afford to support, the government will take from someone else to support you and your children. If you break the laws of this country by entering it illegally, funds will be taken from the producing citizens to pay for your food, shelter, medical care and education of your children. Plus you will not be prosecuted for violating the immigration laws. If you are a small businessman and lose your savings in the stock market due to fraudulent mortgage schemes perpetuated by financial manipulators playing with people’s savings and pension funds, you will be given a cold shoulder by the government. If you are the senior management of the bank that swindled the small businessman, you will be bailed out by the government assuming you gave substantial campaign contributions to the right politicians. If you could not afford a home and took out a loan you could not afford to pay from one of the crooked banks, the government will assist you so you can keep your home. If you saved for years to buy a home and now your mortgage is underwater, it is too bad for you assuming you still work in the private sector and earn an income the government can tax away. If you are senior citizen who lived an honorable life, served in the military, and paid your taxes without hesitation you are a burden on society if you need an medical procedure. Per our President perhaps you should just take a pill for the pain. However, if you are a United States Senator who drove your car off a bridge and shamelessly abandoned a young woman to drown, you are entitled to the best medical care in the world when you have a fatal brain tumor.
We live in a world where the President of the United States goes on television and tell outrageous lies and not be called on it by the press. In our world up is down and right is wrong. Pedophiles are protected and children are murdered as they exit the womb. Crimes perpetrated by a member of one race are hate crimes while the same crime perpetuated by a member of another race is excused as society’s fault. Christian kindness is viewed as an outrageous attempt to impose religion on someone while offensive behavior by Muslims is celebrated as free expression. The founding fathers, who threw off the yoke of a distant king and established the first nation with limited self government, are condemned as racist white slaveholders. Mass murderers who killed millions of helpless people are celebrated as great thinkers and champions of equality. Profanity and vulgar expressions of lewd behavior are considered free expression while condemnation of those same behaviors is considered hate speech. Criticism of the President is racist and disrespectful. His criticisms of others, no matter how far from the truth, are considered evidence of his wisdom.
What is freedom in a world where truth cannot be spoken, the sanctity of life is not respected, lascivious behavior is respected more than dignity, and property accumulated through hard work and savings can be taken on a whim?
Weiner kept saying, “We’re not going to criminalize it”.
They’re going to have a problem if a large number of the workhorses currently pulling the entitlement gravy train—the solid citizens they are counting on to pay-the-way here—decide to go off the economy, people in their 40s and 50s, prime earning years.
They may begin to resent seeing healthy young men playing basketball and fishing and hanging out, as they drive to work or on their lunch hours.
As it is now, the feds recover such things as SS overpayments and IV-D child support arrearages, etc. (and soon, failure to pay `health insurance payroll premiums’) by withholding income tax refunds. If there’s nothing to withhold, they can’t recover in an administrative, civil manner their fines and penalties.
Their only choice then is to use the IRS, or some other feral agency they set up, like ATF, and file criminal citation proceedings. When they start sending John Q. Citizens to jail for refusing to pay their neighbors’ bills—with all due respect to that administration press flack for our foreign chief potentate—then things will get really interesting.
Someone should be making a list now of guys like Weiner because before too long, after the deluge, I expect that we will be checking it twice.
