I agree with you here. Pelosi’s new tactic just sets them back to the beginning. The senate is under no obligation to pass her ammendments unchanged. Any democrat that is voting FOR the Senate bill has no assurances of anything. What worries me now is this executive order regarding the abortion issue that they are working on. If Stupak gets duped by it, then Piglosi will have the votes to pass the Senate bill. It will not end there however as many lawsuits over the Senate bill are being drawn up by the states and other organizations.
The vote is scheduled for tomorrow. Whatever the vote count is now is nothing more than a poll. it’s not a real vote. So no. They would not do that immediately.
Last I heard they have 217 votes for.. They’ll pass it the Bastids!
Unfortunately it seems as if they could just assess a tax on everyone, then give an exemption equal to that tax to anyone who buys insurance, if they were required to do a work-around on it.
The House can’t pass a reconciliation bill when the Senate bill is not law. It isn’t law until signed. That is the problem they were trying to get around with deem and pass. They know the House Dems are afraid after the Senate bill becomes law the Senate will not take up reconciliation. And even if they tried to take it up, reconciliation would cause several key aspects of the bill to be stripped out because points of order would succeed against them. Reconciliation is a budget tool and can’t handle policy matters. Therefore the bill would change in the Senate and be forced back to the House for ANOTHER House vote. Eventually the two chambers would have to pass the same bill or else have it compromised in a joint conference committee.
Now this does sound "series" AND "hugh" I hope the rats are forced to go on record voting up or down on the Senate Bill. The Bill That Madam Speaker says no one wants to vote for. I didn't or don't mean to say there is no Deem and Pass. What I'm saying is that the procedure of Deem and Pass doesn't amount to a hill of beans in changing anything except confusing people.
In other words, if the House approves a Deem and Pass legislative rule, the Senate Bill in its entirety would also have to be in the Deem and Pass legislative rule.
It's still an up or down vote on the Senate Bill, there's just an extra transparent layer on top of the Senate Bill to confuse people and to give some cover.
Yes, which is why this is a major setback for them. They now have to commit to the senate bill with no assurance that the senate will pass their amendments.

Agreed. It has nothing to do with them having the votes, and I think there are more that are jumping ship. The switchboards at Congress are still "all circuits are busy" as of about an hour ago.
The EO strategy worries me too. What if Obama signs an executive order with the house amendments in it?

It would never pass judicial review, just ask Harry Truman. Presidential Executive Orders cannot undo enacted law. It doesn't work that way.

They wouldn’t have created all the ill will and outrage over deem and pass if they didn’t have to. They’re evil but not stupid.

It would go straight to the Supreme Court then as an abuse of power, seperation of powers issue. I hope he tries it...it would be grounds for impeachment.
I suspect not. I think they’re just in total chaos, and forced the Sunday deadline to get a vote in before Easter and see where the chips landed.
