It won’t matter. the EPA routinely ignores court decisions and orders it doesn’t like. EPA people have been overheard saying that they don’t have to listen to courts.
But what they plan to do now is based upon a court ruling that said carbon dioxide is a pollutant. They listen to the court when it serves their purpose.
