I just got finished talking to a very knowledgeable person about this process and was told that Obama wouldn't really go with reconciliation, it's just a threat. Obama will probably go for a plan B that he will then call a victory instead of reconciliation because reconciliation would have to include a sunset provision and most of the bill would have to be ruled non-budget related. The mandatory requirements will probably be ruled unconstitutional by some federal court so that would pretty much kill it.
