DOJ: No misconduct for Bush interrogation lawyers ("poor judgment" maybe, but not misconduct)

WASHINGTON – Justice Department lawyers showed "poor judgment" but did not commit professional misconduct when they authorized CIA interrogators to use waterboarding and other harsh tactics at the height of the U.S. war on terrorism, an internal review released Friday found.

The decision closes the book on one of the major lingering investigations into the counterterrorism policies of George W. Bush's administration. President Barack Obama campaigned on abolishing the simulated drowning technique of waterboarding and other tactics that he called torture, but he left open the question of whether anyone would be punished for authorizing such methods.

An initial review by the Justice Department's internal affairs unit found that former government lawyers Jay Bybee and John Yoo had committed professional misconduct, a conclusion that could have cost them their law licenses. But the Justice Department's top career lawyer reviewed the matter and disagreed.

Wasting their time?

I guess I don't know to what extent, but I imagine Holder's DOJ has had all kinds of Bush administration lawyers and advisors in for questioning, just to let them spend their personal money--as with Scotter Libby--while the DOJ's lawyers sit flush on the taxpayer funded side of the table.

Part of the damage done by the Holder DOJ will have been to make sure talented conservatives/Republicans view it as financially unattractive and retirement-threatening ever to consider working in a non-leftist administration.

The Radical Socialist Dems and thier Muslim allies spent YEARS ginning up the hate against Bush. They would have a tough time explaining this to their sheep ifollowers if the world were perfect. But the haters will simply go Orwellian, and act like it NEVER HAPPENED.

I have a friend who is a lawyer and left of center. She’s not a total liberal (she’s pro life for example but her other leanings make me call her left of center if that makes sense).

She says that this whole thing was scary. Being able to be prosecuted for decisions and legal opinion?

Prior to taking up his current post Holder was a senior partner at Covington and Burling, a law firm that represents 20 detainees. Holder proved how oblivious he was to professional ethics in 2000 when as a deputy attorney general he vigorously lobbied Bill Clinton on behalf of fugitive financier Marc Rich who had made the FBI’s most wanted list on numerous occasions over the last decade. Clinton granted Rich a pardon. Rich, in turn, donated millions to Clinton's library and foundation. Holder was in effect “the bag man” in the most controversial presdental pardon since Nixon got Jimmy Hoffa out of the can early.
