When Obama was teaching constitutional law, his position was that the Constitution should be interpreted so as to allow the powerless to challenge the powerful.

Now that he is the most powerful person in the land, in courthouses across the country his lawyers use constitutional arguments to deny that ordinary people have the legal right to question his constitutional eligibility for the presidency.

His action in going to such lengths to prevent the Hawaiian authorities from releasing his birth records to my mind can only be for one of the following reasons:

- He has something in his birth records so damaging that he needs to hide it from the American people. This from a guy who had no problem admitting, for example, his use of drugs in the past.

- He fears a crack in the dam - that if he releases those records, he would face more pressure to release other records, for example his college records which might show that he renewed his Indonesian citizenship in college, which would have caused him to lose US citizenship by operation of law.

- He and Axelrod believe resisting disclosure is a good wedge issue, since with the MSM on their side, they can try to paint his political opponents as “birther” kooks and marginalize them.

None of these possible motivations says anything good about the president of the country.

I suspect that it dawned on someone at the White House that Obama’s remarks about the supreme court might backfire. They may decide to hear this issue as a way to give Obama the finger.

There are some interesting arguments based solely on the fact that his father wasn’t a citizen. If it went to the supreme court nobody could predict 100% how they would rule.

I suspect there is something damaging on the original (like lists religion as muslim, origninal middle name was Mohammed, or lists someone else as father). That’s pure speculation, but makes the most sense.
