Trying the 9/11 co-conspirators, including Kahlid Sheikh Mohammed, in federal, civilian court just got a bit harder. Support for trying these men in New York City has been dwindling, and some reports indicate the site has been scrapped, though the Administration contends NYC is still a viable option.
Now legislation has resurfaced that would shut off funding for civilian trials altogether, only this time it has Democratic support. Sens. Jim Webb, D-VA, and Blanche Lincoln, D-AR, have joined the fight to deny the funds, making it harder for such trials to continue.
On Tuesday, Sen. Lindsey Graham, R-SC, an Army Reserves JAG officer, will be joined by Lincoln (Webb could attend, says a spokeswoman, but he might be stuck in hearings) and his usual group of colleagues on national security matters, Sens. Joe Lieberman, a self-styled 'Independent Democrat", and John McCain, R-AZ, to unveil their bill. Sen. Saxby Chambliss, R-GA, a co-sponsor, will also attend.
A Graham spokesman says the senators "will offer it as an amendment to the first thing we can get it on." It is unclear what the next piece of legislation will be to hit the floor, but Democrats are pulling together a jobs bill that they hope to bring to the floor in the coming days.
A Reid spokesman declined comment.
As a former Navy secretary and key member of the Senate Armed Services Committee, Webb is a crucial vote of support for the bill.

I’d say they specifically deny funding to criminal trials in federal court for the named individuals.
Obama claimed to want to have him on trial in civilian court to show the world our great court system. Then goes in front of the entire country and claims he will be found guilty and executed. Oh yeah they will show the world.

Congress can stop federal entities from doing things it doesnt like by passing legislation that prohibits the from engaging in a specific activity.
As long as the prohibition is constitutional.
KSM should've been executed a long time ago. Giving any of these terrorists access to out Article III Courts, complete with discovery, and confrontation of witnesses, is unbelievably stupid.
That said. Do we really want Congress to set a precedent that it can, in effect, grant someone permanent immunity from Federal prosecution, in Federal Court, just by slipping a rider into a bill that says "No funds may be drawn from the Treasury by the Justice Department for the prosecution of A.B.?"
If Congress really wants to man up, it should impeach Attorney General Holder, for giving aid and comfort to the enemy, by turning over (or attempting to) classified material to terrorists. Remove him from office. And remove every successor, or appointed subordinate, until BO gets the message, and orders the decision to give terrorists civilian trial sis reversed.
These lapdogs already have shown their colors. They are toast no matter how they vote in 2010.
The Obama administration is asking for $200 million in taxpayer dollars to fund security for the trials. It was this estimated expense that caused Bloomberg to request NYC not host the trial.
Obama now appears to be offering the $200 mill to whichever venue agrees to host the trial.
This is a move to cut off such funding -- and force the trial into the military court system, where it belongs.
