Despite pledge, Reid calls major Senate vote

Despite a promise that he would not "rush" important votes before Massachusetts Sen.-elect Scott Brown is seated sometime next week, Senate Majority Leader Harry Reid, Nevada Democrat, has scheduled a Monday vote on the contentious nomination of M. Patricia Smith to be solicitor for the Department of Labor.

Mrs. Smith, now New York's labor commissioner, has come under fire from conservatives and some business groups for the state's "Wage Watch" program. The project, which started in January 2009, enlisted unions and advocacy groups to visit private businesses, educate employers about labor laws and report potential wage violations to the government.

Sen. Michael B. Enzi, Wyoming Republican, who is the ranking minority member on the Senate Health, Education, Labor and Pensions Committee, has put a hold on her nomination and asked President Obama to withdraw his nominee, charging that she gave inconsistent testimony before the panel about the program.

Fellow Massachusetts patriots: might it be time for a Boston Tea Party on Beacon Hill, to demand the certification and seating of our duty elected Senator? We are being taxed without legitimate representation at this point - the Kennedy placeholder has no mandate to be casting votes anymore.

I’m pissed.

Mr. President, I ask unanimous consent that when the Senate completes its business today, it adjourn until 2 p.m. Monday, February 1; that following the prayer and the pledge, the Journal of proceedings be approved to date, the morning hour be deemed to have expired, and the time for the two leaders be reserved for their use later in the day; that the Senate then proceed to a period of morning business until 3 p.m., with Senators permitted to speak for up to 10 minutes each; that following morning business, the Senate proceed to executive session to debate the nomination of Patricia Smith; finally, I ask that the RECORD remain open until 12 noon today for the introduction of legislation, submission of statements, and cosponsors requests. The ACTING PRESIDENT pro tempore. Without objection, it is so ordered.

Mr. REID. Mr. President, the next vote will be at 5:30 p.m. Monday. That will be on the motion to invoke cloture on the nomination of Patricia Smith to be Solicitor for the Department of Labor.

I announced earlier that the vote on Monday will end at 5:50 p.m. If somebody’s plane is late, or whatever the situation, that is what it is going to have to be. We have to close that vote for procedural purposes, as everybody knows.
