Filmmaker Who Targeted ACORN Appears in Court on Felony Charges

Three of four men charged with illegally entering the New Orleans office of Democratic Sen. Mary Landrieu returned to court Wednesday for pretrial meetings with authorities.

Suspects Defendants James O'Keefe, Joseph Basel and Stan Dai all carried suitcases and declined comment. The fourth suspect is Robert Flanagan.

Federal authorities said two of the men posed as telephone workers wearing hard hats, tool belts and fluorescent vests when they walked into the senator's office inside a federal building in New Orleans on Monday. The other

My O’Keefe Theory

Since everyone else is running with their smears, hopes, fears, rampant wild speculation (a lot documented at Patterico’s site), etc., I thought I’d throw our what I think is a somewhat reasonable theory as to what James O’Keefe and company were doing in Sen. Landrieu’s office.

Looking at the affidavit, I noticed an interesting fact on page 2, section 6:

BASEL requested to be given access to a telephone in the office, and WITNESS 1 allowed him access to the main telephone at the reception desk. WITNESS 1 observed BASEL take the handset of the phone and manipulate it. BASEL also tried to call the phone with a cellular phone in his possession. He stated that he could not get through.

Now. If Basel is telling the truth, then it lends credence to the fact that people calling the reception desk telephone at Landrieu’s office could also not get through to the main phone.

As such, I am postulating that the group was trying to document (with video camera) that Landrieu’s office had either disconnected or re-routed the phones to deflect incoming calls - hence, why they couldn’t get through. There have been anecdotal reports that Landrieu’s office has received complaints that it has been inaccessible by phone, particularly around the time when she was bought off by the Democrats for the now-infamous Louisiana

My bet is more towards the $15 fine. Landrieu might well have the whole business dropped (and have you and I pay for their legal fees) rather than have this continue.

Her people have falsely told her constituents that the phones don't work ~ but obviously the phones do work!

Frequently the return number on one of these courtesy phone operations is not posted on the handset. That's so you won't be calling in on it later ~ which is very annoying ~ and idiots do keep the last number they saw moreso than the last number they were told to call.

In most cases you have to pick it up on an incoming cellphone call to find out what it is ~ unless, of course, the PBX jockey has rigged it to give you the DIN, then you're sunk!

The sequence of the filming operation strongly suggests they succeeded in making a call out, and then returning it to the same number. If one of them said they couldnt' get a call, I'd want to hear a tape!

BTW, they didn't "lie" to get in. It's an open office within a federal building. If asked you tell the guards what office you are going to. She has an invitation out to visit her offices.

If they told lies later, it's not about getting in.

I’m not so sure being arrested and charged with a felony was or was not in O’Keefe’s plan, but recall how the ‘roll out’ of the ACORN scandal was handled. One tape released, furor from the left, denial of any untoward behavior, it was aberrant, etc. Then another tape release, and another, until all excuses were exhausted and ACORN was locked into its position. There may be a method to what appears as O’Keefe’s ‘madness.’

Maybe a stupid question, but why did they bring suitcases? Is that in anticipation of spending the night in jail?

Probably because they were finished with their business in NO and going home after the hearing.

The US marshals show up so they had been following James or wiretapping him. I cann not see the office worker picking up the phone and call in the Feds. If he was wiretapped how could the justice dept authorize this. In Calif there was a tape where our Attorney General Brown told Acorn not to worry for they either had them covered and the outcome known or the fix was in.

A variation that makes more sense. Due to the heavy incoming phone traffic (from people POd at the old bat) the office manager's had the PBX gurus set the phones to report a busy signal on all incoming calls, but the office workers could continue to make outgoing calls for ordinary office business.

Supplement that with a bit of work with your cellphone and you could do office business as though nothing was wrong.

So, that's the view from inside the office.

Now, the next thing ~ someone didn't believe the phones were all busy in all the offices so they visited one of 'em.

The first thing they did was try an outgoing call to their cellphone numbers. That worked.

Then, they tried an inbound call from their cellphones. That didn't work (hence the alleged witness saying one of them allegedly said he didn't get a call).

It all makes sense now.

O'Keefe could have stopped right there if he knew something about modern computer driven PBX operations because he proved they'd set their phones to report "busy" on all incoming calls.

Obviously he didn't know what he needed to know about PBX operations and he continued the trick when he should have simply left.

BTW, that scenario accounts for the office geeks being able to contact the US Marshalls and the FBI to come on down and get these people. They'd still be able to escape in time though the second the call didn't go through.

In the future O'Keefe should consult with people who know how to work PBXs.

Very good! Sounds plausible to me...this kid has moxie that's for sure.

Good to see that on our side for a change, let's hope he learns some lessons from this, and I hope he does not go to jail.
