The judicial keelhauling of New York's Bravest continues apace.
Federal Judge Nicholas Garaufis -- without a shred of evidence that the FDNY had discriminated against minority applicants -- last week imposed strict racial hiring quotas on the department.
For every five new hires, Garaufis ordered, the department must reserve two spots for black applicants and one for Hispanic applicants -- until precisely 293 minority firefighters have been hired.
He also ruled that fully 7,400 minority applicants who took the FDNY entrance exam in 1999 and 2002 could claim monetary damages from the city.
It's a ruling as absurd as it is offensive.
Absurd -- because, despite Garaufis' pinpoint precision in judging exactly the ratios needed to satisfy the purported demands of racial justice, his evidence for actual discrimination doesn't exist.
Indeed, he ruled that merely because the test used in '99 and '02 -- which no one has demonstrated is anything but totally job-related -- didn't produce the desired racial outcome, FDNY brass must have been intentionally biased against minorities.
That's nonsense on stilts: The FDNY didn't become the best metropolitan firefighting force in the world by focusing on anything but whether applicants could do the job.
On the other hand, injecting considerations other than competence into hiring decisions is the first step down a dangerous path.
Besides, few things are more offensive to American notions of fairness and equity than strict racial quotas.
To be sure, there are probably a number of things the FDNY can do to boost the minority presence in its ranks.
But on this ruling, a vigorous appeal -- to the Supreme Court, if necessary -- is more than appropriate.
Basic fairness demands it.

There is nothing new about this. I do construction work for the government as a sub and have for many years.
Last year I was on a project and the superintendent came up to me and said..”Buddy, you gotta hire at least a few ******’s or we’re gonna have to get someone else. we have quotas to fill.”

The only group we can legally descriminate against are whites. Why would any white person vote Commucrat? Why not do away with all hiring criteria? Whoever walks in first gets the job.

A little confusing. Should that say of every five new hires (2-2-1), or does it mean for every five whites (5-2-1)? I suspect the first is correct, but I confuse easily these days!

Yeah, but there's the expense and the delay. Also, there are some racially partisan politicians who will pressure to not appeal and use this as a legal precedent.
I am a retired Firefighter and I can tell you I have been in burning buildings with unqualified people hired under affirmative action. The city hires them and you work with them, you have no choice. Some of them were not bad Firefighters.You really dont have to be real smart to enter a building that others are bailing out of.
The problem comes with promotions to drivers and Officers.
People who cannot pass a test to be appointed also cannot pass a test to operate Emrgency vehicles., They don’t properly learn their districts or study the buildings in that district.They cannot pass a test to become Fire officers.So they sit around and complain of being discriminated against.
They forget that they shouldnt have been hired to begin with. So the Fire departments start rewriting tests so that an idiot could pass them or they give preferential treatment to them to get them officers jobs. THAT is when the trouble starts.
Now you arent going into a building on fire with someone who isnt real bright,but can direct a hose stream ,or put up a ladder. Now you have an idiot in charge of you.THAT can get you killed.

So, what if a scenario emerged where the black and hispanic candidates are substandard to the white ones? Not as qualified, test scoring not as high etc.
The public has been told to settle for less than the best all in the interest of Affirmative Action.

Wel, as you know it’s been a long time since the City of Chicago burned to the ground, so it’s OK to slack off a bit.
How do they determine what “race” is and who is who or what?
I am wondering what they are supposed to do with someone like Obama, hire the black half and refuse to hire the white half?
