Great points. Obama and Holder are to blame for this,,,not the judge.

Right. Did Obama and Holder want to ruin the civilian criminal justice systems for American citizens by forcing a judge to throw out established law on coerced confessions? Or did they want these terrorists to walk?

Next issue that would free them, if their confessions are not suppressed, would be speedy trial.

Holder is a former Judge. Both he and Bambi know what they are doing, so it is all the more insidious.

And Obama and Holder hinting around that they will continue to hold these clowns even if the civilian court acquits them? Pure poppycock. There would be a Double Jeopardy claim so that military courts could not touch them. Only the Hague would be a next forum, and those folks would greet them as heroes.

The key is as soon as anyone reaches US Soil (which Gitmo is not) they gain all 14th amendment rights, due process, attorney, jury trial, exclusionary rule, 4th, 5th, 6th, 7th and 8th amendment protections, which are generally afforded to US Citizens. Bringing them here for trial or switching them from Gitmo to Illinois gives them the full array of “rights”. That is the true crime.

In civilian criminal courts “coerced” can be a lot less than waterboarding. It can be as simple as telling a suspect to confess or they may have to think about charging the guy’s girl friend, mother or brother. The test can be as simple as a “will overborne”. Was the confession truly “voluntary” or was the detainee pressured?

Once again, terrorists do not belong in civilian criminal courts on US soil!!!!!!!!

Holder and Bambi know this. They either wish to erode rights for ordinary US citizens or they want these guys to walk.

“It just looks like obama/holder have stacked the deck for the terrorists and against us.”

You do realize they are doing it DELIBERATELY, don’t you? The only other possibility is that lawyers could be this stupid, I don’t think they are the geniuses that the left wants to call them but if they were that kind of stupid I would expect them to be glassy eyed, slack jawed and confined in a mental institution where they would be spoon fed.

“ROTFLMAO at the idiot liberals who wanted to give terrorists the same rights as US citizens!”
/////////////////////////////////////////////////////////////

It is not funny and they are not really idiots, they are doing this maliciously. If you are laughing about it you may need to reevaluate just who the idiot is in this case.

Upon reflection, I'd have believe they'd be satisfied with either outcome.

And I'm thinking that maybe, just maybe, Obama's surprising anger expressed at his statement from Hawaii was because the Xmas bomber had compromised his plan to engineer the release KSM, et al

After all, to his strategic mindset, how better to mend fences with al-Qaeda than to release the perpetrators -- demonstrating how very, very fair his America really was.

Then, along came this Umar Farouk Abdul Mutallab blundering into his carefully laid scheme...

Far-fetched? Yeah. But still a possibility...

>>”This is a HABEAS CASE filed when Bush was President, after the U.S. Supreme Court said it was OK for Gitmo detainees to do so.”

That is how I read it also. But I don’t think anybody else bothered to read it.

It is a shame the Military did not have a little more control over this one. They could have quickly put this scum bag on a C17 and delivered him to the prison at Bagram AFB. Never to be seen of again. Holder and zero do not want this POS interrogated in order to yield information on AQ.

Why not reserve your contempt for the persons actually responsible: Eric Holder and Obama? They are the ones who removed these perps from a perfectly legal wartime detainment regime....

One more time - no, they did not. This is a habeas petition case.

Has anyone considered that this could have been a ‘planned’ event within zero’s circle? Think about it ... he’s on a golf course and does not respond, but quits his game when his friend’s kid skins his knee and an ambulance is called ... and the other idiot decided to go skiing since it was his kid’s 7th birthday and saw no urgency. I also consider that this could be how zero will push through RealID, remove our consistitional rights ... the healthcare bill is a fine example of this.

I would prefer to be lucky enough to be wrong. No one wants to believe that our president is working against our countries best interests when it comes to people who are trying to kill us. At least I don't.

Now that I've answered your question, you can answer one for me.

Why did you write to me in such manor? Why form your post to me as if you are too ignorant to speak correctly, purposely running your words together along with misspelling them? What is your point?

Exactly why we should ‘Take No Prisoners”!

Can't (effectively) interrogate them anyway, and then we release them. What's the point?

Just having a liitle fun, it is the way many of the people I grew up around used to talk, I probably sounded that way myself as a boy. One of my favorite TV characters of all time was Festus on the old Gunsmoke show and he sounded rather like that.
