President Obama's health-care bill is now moving toward final passage. The policy issues may be coming to an end, but the legal issues are certain to continue because key provisions of this dangerous legislation are unconstitutional. Legally speaking, this legislation creates a target-rich environment. We will focus on three of its more glaring constitutional defects.

It’s not like there’s any chance of them being stopped. The Supreme Court won’t blink an eye.

I have ZERO faith in the SCOTUS to find Obamacare unconstitutional. Probably 5-4 with Kennedy allowing ZeroCare.

What’ this? Is that a bit of a backbone I see sticking out on Orrin Hatch’s back?

One wonders how long it will be there; about as long as it takes for Shumer to give him a deep wet kiss?

Good for Ken Blackwell. This is the kind of leadership we all yearn for. Are you listening Michael Steel? (yeah didn’t think so)

“Who really believes the Sotomayor Court won’t bless ever criminal act in this bill?”

Luckily, she only has one vote.

SHe replaced a liberal so her appointment will make no real difference to the vote 5-4 or 4-5 depending.

This Health Care Debacle is riddled with unconstitutional provisions. I don't think the Repubs should be giving any specifics other than a general “...this bill is unconstitutional...”.

Giving specifics only give the socialist baskers a heads up on what to modify or remove (i.e. hide even deeper in vague, contradictory language). Specificity also gives the corrupt leftist supremes time to prepare irrational rationalizations of why those socialist provisions aren't unconstitutional. Let's see these scumbags at least try thinking on their feet for a change.

Sure give it all away, and let the dems change the wording enough to pass muster with the Supreme Court. It's a wonder how we ever won WWII.

Most things this congress tries to do are unconstitutional. It is amazing that democrats are unconcerned with actual achievement: they have spent an entire year in legislative theatre. They’re the stars of the show, and they won’t forget it for a second.

If democrats have a weakness, it is blindness to the comedy of their own actions. What they don’t know is this show of theirs is a morality play, and we have just seen the first act, called “Folly.” The next act will be called something else, maybe “Fall of the Mighty.”

The Canadian Parliament had absolute powers before the enactment of a Charter Of Rights. In theory, it could make any law wanted. In contrast, the US Congress always has had enumerated powers. It can make laws only in areas in which the Constitution specifically empowers it to legislate. It cannot make any law it likes.

I had some of Ken Blackwell’s fine honey with my breakfast this morning. He sends us a jar of his home grown honey every year for supporting his Young Republicans Training Institute...

Oh, very nice!

I actually met him once outside of the building where I work. I did a double-take and he knew that I knew who he was and gave me a little smile. :-)

Yeah, no SCOTUS intervention but.....this is a good truth to remind the public that the Dems often skirt the Constit. for some socialist leftist radical domestic or even national security plan just to please the leftist nutters that make up the core of the Party .
