Vt. Judge: Birth Mom Must Give Child To Ex-Partner

MONTPELIER, Vt. -- The birth mother of a 7-year-old Virginia girl must transfer custody of the child to the woman's former lesbian partner, a Vermont judge has ruled.

Vermont Family Court Judge William Cohen ordered Lisa Miller of Winchester, Va., to turn over daughter Isabella to Janet Jenkins of Fair Haven at 1 p.m. Friday at the Virginia home of Jenkins' parents.

Miller and Jenkins were joined in a Vermont civil union in 2000. Isabella was born to Miller through artificial insemination in 2002. The couple broke up in 2003, and Miller moved to Virginia, renounced homosexuality and became an evangelical Christian.

In the Dec. 22 order denying Miller's request to delay the transfer of Isabella, Cohen wrote: "It appears that Ms. Miller has ceased contact with her attorneys and disappeared with the minor child."

Liberty Counsel attorneys who have represented Miller in the past did not immediately respond to telephone messages left Tuesday by The Associated Press.

A listing for Lisa Miller in Winchester, Va., says the phone line has been temporarily disconnected at the customer's request.

Good points & I agree with you totally. Sorry for the lengthy comments below....

It is a complete travesty of justice for our judicial system to rule like this in favor of a lesbian, sexually abusive partner, who is not the biological mother. As I pointed out in post #115, it is a massive outrage and can you imagine how the courts would have ruled if it was a heterosexual person filing for permanent custody of a biological child of a homosexual or lesbian parent??? The case would be thrown on out & dismissed without merit. But this is a custody case filed by a radical, anti-Chritian lesbian Jenkins, who has sexually abused the 7 yr old girl, and yet those charges were simply dismissed & disregarded by the courts. This is what happens in a country where evil is promoted as being good, and good is promoted as being evil.

This is not just a custody battle. This is another battle to force the homosexual/lesbian agenda upon us, and the best interests of a 7 yr old girl are simply ignored & dismissed by the bastard judges in Vermont and in Virginia, and are now being appealed once again (not a snowballs chance in hell I am afraid).

There are lots of good postings about this, plus on WND.com right now, if you scroll down, you will see a number of very good articles that point out the travesties & injustices here.

Unfortunately our country is now guided & misguided by evil politically correct agendas....a massive promoting of homosexual/lesbian lifestyle & culture, a massive promoting of Islam as the most favored religion in the world, a massive hatred of anything Biblically Christian (as opposed to liberal Christianity) and a massive hatred of the U.S. as it was founded on Christian values, morals & principles. I sadly predict that in the end, Ms Miller will lose her own biological 7 year old child to a lesbian in Vermont, Ms Miller will likely go to prison for 20 years or so with hate crimes added in, and her child will be raised by a lesbian and taught to become a lesbian. That is my prediction.

There was a case years ago in DC where a mother accused her former husband/father of her child, of abuse, and she fled to NZ and stayed for a while. I don’t remember the details, but she did end up coming back, whether or not of her own volition.

BTW-Could you please point me to where I stated that one of the one of the lesbian mothers should not gain custody of the child?

Two things, first the US and New Zealand enjoy the benefits of an extradition treaty signed and ratified by both countries in the early '70s. Second, New Zealand, and every other country on the planet save for two, are signatories to multiple UN and Hague treaties regarding child kidnapping and rightful return. Essentially, no matter where this woman may flee to, her child will eventually be returned to the US, even though she may not because of limitations on or the absence of a formalized extradition treaty.

If the other mother has custody, she will still have full visitation rights.

Parenting is not about genetics. It’s a verb, and it’s about who loves and treasures and cares for the child. These two set out to parent this baby. It’s like adoption for the other parent.

Of course it will be terrible for the child. One should not divorce unless one parent is harming the other parent or the child. They should have lived together forever, even platonically, and made themselves get along while they love and parent their precious child. And if they had to split, they should have lived in the same neighborhood.

I haven’t been able to determine whether the lesbian adopted the child. If she did, her rights are as valid as the birth mother (barring any abuse).

Should be a note to anyone who marries or partners up with someone who is not the biological parent of your child—be very very careful about letting the step parent adopt. You are giving up the complete freedom to choose the proper future for your child.

That would without question solve the problem for the court as no judge in the land will grant custody to a parent who is doing 20 years in prison for kidnapping.

Apparently, this is not needed. In this brave new PC world in which we live, mere biological and bonding relationships no longer make you fit to be a parent. If some outside party can find a willing judge to contort "facts" enough, (plenty of those around), then they can get your child.

Consider the child in the UK who was taken from her unfit drug addicted mother but was not allowed to be raised by her able, willing grandparents but were given to a homosexual couple instead. The grandparents were harshly threatened by the court with never being allowed to see their grandchild again if they protested because of the couple's sexual orientation - an unforgivable sin in the UK. This is right around the corner for us.

It is no longer beyond the realm of possibility for the homosexual lobby to bring suit to remove the child from a family which teaches their child the biblical truth that homosexuality is an abomination. Thanks to the new "hate-crimes" addition, such a group can, unbelievably, have standing in a liberal court.

We have today's descendents of dinosuars with reptiles such as crocs & alligators & gila monsters. But let's not hijack this thread to talk about your fixation with disparaging Joe Farah or WND.com. Apparently you like the slanted news from MSM. Call up Mr Joe Farah. I can guarantee you would come out the loser in any discussion with him. Take the challenge. Set up a conf call and I would love to listen in on your debate.

You keep disparaging any comments regarding Ms Miller and voice your support for her to just give up her 7 yr old biological child to a sexually abusive, very mean-spirited lesbian who happens to be her former partner and hates Christianity with a passion now that Ms Miller became a born again believer. I hope Ms Miller does the right thing for her child and goes into permanent hiding vs allowing her child to be forcibly taken by a godless, pro-homo/lesbian court system and turned over to a sexually abusive lesbian who has no biological connection to the child. We are at war against socialism, secular humanism, homosexuality/lesbianism, and I prefer to fight them anyway we can. I would be more than willing to contribute to any fund necessary to support Ms Miller to hide from a socialist-fascist-communist system.

My understanding is that the child is not adopted by the non-birth mother. From the articles I have read, the lesbian Ms Jenkins would force the 7 yr old girl to bathe naked with her. Following weekend visits with the Vermont lesbian, the 7 yr old girl would arrive back to her biological mother in Virginia, with recurring nightmares, bed-wetting and other traumatic disorders. Since the courts in Vermont especially have a decidedly pro-homosexual /pro-lesbian agenda, they just discounted any reports of sexual abuse and it made no difference in their decision to allow for continued weekend long, un-supervised visit with the lesbian. A state court in Virginia agreed with the biological mother, that the visits should not continue and that Ms Jenkins had no rights to the child, but a VA appeals court overturned that decision and the VA & Vermont Supreme Courts held up the initial Vermont court ruling. This poor mother, Ms Miller simply wants to raise her how young girl, and the courts are adamant to take her daughter away. I hope & pray that Ms Miller will go into permanent hiding for herself & her child, to keep her child from being indoctrinated & abused by a lesbian for the next 11 years. I would be more than willing to contribute regulularly to a fund set up to support Ms Miller in her hiding.

The child was born in Virginia and has lived in VA most of her life, but the Vermont court to control over the case and overruled VA, and the SCOTUS let that stand.

The child is being removed from Miller, because Miller refused to follow the guidelines set down by the court and fled with the child.

That doesn't mean the decision isn't harmful to the child. How about a punishment for the mother that doesn't result in the child being shipped off to a woman she barely knows and having her life disrupted?

Mr. Joe Farah did not simply say that decedents of dinosaurs are alive today, but rather his position is that dinosaurs, specifically, pterodactyls are alive today and living on the earth.

And I am very sure that I would win a debate with you or Mr. Farah on the question of pterodactyls flying over the earth in the 21st century.

Could you please point me to the disparaging comments I made about Ms. Miller?

And could you please point me to the place in the Constitution that states that people that "hate Christianity should not be permitted to have visitation with their children?

Finally, could you please tell me why Ms. Miller's former domestic lesbian partner has not been charged with sexual abuse of a child?

From what I have read on this matter there does not appear to be any substantiated claims of sexual abuse.

Homosexuality is not the equivalent of normalcy, and this nightmare which is wrecking the lives of the child and her mother - who has now renounced homosexuality - is being discussed as though there is any Constitutional, ethical, moral or legal standing for making this child live with the ex-"partner". And people on FR are either outwardly or tacitly supporting the homosexual agenda on this very thread.
