The next vote is scheduled for 1am Monday

Then they expect to completely vote it in on Christmas eve.

McCain says he will make them read this new “amendment” -that Reid and Marx drew up in the dark of nite- aloud in the chambers.

But that will merely slow it down.

I have a lawyer here who says it’s unconstitutional and said that all parties know it’ll be tossed out, but for now it gives Nelson cover and makes Nebraska voters feel good about his vote.

Well, we shall see.

The whole process of getting the Supremes to hear a case is flawed and makes all this discussion about 0’s and the Senate’s unconstitutional practices a complete waste time and renders the Constitution worthless most of the time.

I was just looking at the Constitution. While I can't find the clauses preventing binding future congresses, I do see where a "full faith and credit" argument can be made.

Article IV, Section 2, Clause 1:

The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.

Does this mean that Californians are entitled to the same deal that Nebraskans just got?

Judas was a Piker compare to the denizens of congress and the likes on Nelson. Judas is in Hell gnashing his teeth as to why he didn’t hold out for more than 30 pieces of silver.

These states that got these sell-outs for the rest of us to pay for, Nebraska, Louisiana, Nevada and who knows what others - They are going to find out Obama will stab them all in the back. Just wait, he will figure out a way for them to pay in the end. That’s the way Obama works.

I just emailed both my senators asking them why *they* didn’t get exclusions for their constituents. LOL

I asked them, if the bill is so good, why are others getting exemptions?

I accused them of not protecting the people in their home states!

At a minimum, it would seem to me that there are clear equal protection problems for any insurance company outside of Nebraska, where this is violating their Constitutional rights under the 14th Amendment. IMHO, standing and justiciability would easily be met in such a case.

Also, just on first blush, it would seem that any taxpayer (or state) outside of Nebraska might have 14th Amendment issues. I can't think of any Federal tax that is written to either include or exclude specific state(s). There are taxes that, as a practical matter, may only affect a singular state, but usually that's because only a particular kind of business - like Almonds, farmed almost exclusively in California - may only be located in one state.

This is something entirely altogether different.

Sounds like a plan to me, and the other states too.

But like Pelosi said when she was asked if this kind of stuff is ok according to the Constitution, "Are you serious? Are you serious?"

I don't see how they couldn't be. There are exceptions to that clause, at least the Supreme Court has found exceptions for that clause, but those were all cases, IIRC, that involved certain treaties or allowances for indigenous peoples - native Americans, HI, Eskimos etc. Nebraskans, as best I can tell aren't indigenous peoples.

This needs to be one of our positions on this.

The Giant Suckling sound is jobs going to Nebraska because of a different federal laws and tax structure.

Did Nebraska get rid of OSHA as well?

Here's more.

Article I, Section 8, Clause 1

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

Does this deal with Nebraska count as a duty, impost, or excise? Does it have to be uniform throughout the United States?

Article I, Section 9, Clause 6

No Preference shall be given by any Regulation of Commerce or Revenue to the Ports of one State over those of another: nor shall Vessels bound to, or from, one State, be obliged to enter, clear, or pay Duties in another.

Does this deal with Nebraska make it cheaper for the state to operate its airports because of the cheaper healthcare costs of its workers?

I’m fron Nebraska originally and when I ask people in good conservative Red states like Nebraska and Iowa why in hell they elect so-called “Conservative Democrats” like Nelson, the answer always comes down to farm subsidies.

This is strange. There have been no real farm subsidies for years. The farmers used to take a "loan" on their grain and if the selling price never got above the loan rate, they would for-fit their grain to the government. The last few years the price of grain has been much higher than the loan rate.

The only current active subsidy I am aware of is on crop insurance. It is required if you want to participate in the farm program. Crop insurance is probably a good idea in Nebraska, especially for dry land farmers.

Mr. Reid convened an early morning caucus Saturday to discuss the developments. Congressional aides said the Senate was likely headed to a vote Monday, possibly at 1 a.m., on a pivotal motion to close off debate on the health bill. The vote will be the first true test of whether Mr. Reid has all 58 Senate Democrats, as well as the two independents who sit with the majority, behind the White House-backed health initiative.

Liberals have expressed unease at Mr. Reid's frequent concessions to centrist senators such as Mr. Nelson.

Capping a week of growing complaints from liberal groups, MoveOn.org on Friday asked its five million members to sign a petition opposing the Senate bill. The group is frustrated that Democratic leaders stripped a public health-insurance plan.

But White House Chief of Staff Rahm Emanuel pooh-poohed talk that some liberals might vote against the bill. The White House has made the calculation that the liberals will swallow the concessions because they have learned from past failures not to pass up the chance to create near-universal health insurance.

"There are no liberals left to get" in the Senate, Mr. Emanuel said in an interview.

Good ol' Rahm the Enforcer, fish stabber, hitman etc. They know to please Emanuel is to stay alive.

MoveOn and the unions (SEIU and others) are royally in a snit because it doesn't include the public option because they are promised tens of thousands of jobs by Obama (they bought his election so he owes them) in the health care industry.

I noticed that in this article that Rahm Emanuel got all "poo poo'd up"...
