Put that aside ... she was an American citizen ... the point is the father was a foreign national ... who returned to Kenya after completing his studies in the U.S.. Both parents must be U.S. citizens, born in this country, in order for an individual to qualify for the office of POTUS.

At the time BO was born federal law required for births between December 24, 1952 and November 13, 1986, a parent to be physically present in the U.S. for at least ten years, five of those years after the age of fourteen in order to transmit citizenship to him. Consequently his mother needed to be at least 19 years of age however she was only eighteen and therefore unable to transmit her U.S. citizenship to him.
