My suspicion is that if he is arrested, it will be for tax evasion. Nonprofit churches are banned from partisan political activity, and if their tax exemption is revoked.... I’m not sure I would call this “partisan,” though. And I can’t perceive any reason why Homeland Security would be interested in this.

Separation of church and state....

That's the very reason why that Constitutional clause was in there, to protect the church from government interference, and to keep the government out of the church's business.
