I'll bet he is thinking that the EPA is going to do it even if the senate won't play ball. I still can't believe the mindless SCOTUS made this ruling in 2007:

"EPA has offered no reasoned explanation for its refusal to decide whether greenhouse gases cause or contribute to climate change," Justice John Paul Stevens wrote for the majority. The agency "identifies nothing suggesting that Congress meant to curtail EPA's power to treat greenhouse gases as air pollutants," the opinion continued.

I’m hoping there will be a lawsuit to force EPA to disclose the “science” supporting it’s pollutant finding. I’m betting it’s the junk science the email fraudsters have been producing.
