Senate confirms Obama judge pick WASHINGTON - The Senate confirmed U.S. District Judge David Hamilton of Indiana yesterday for the Chicago-based U.S. Appeals Court for the Seventh Circuit, approving a nominee targeted by conservatives as a liberal activist.

Senator Richard Lugar of Indiana was the only Republican to vote for the judge's confirmation. Lugar called him "superbly qualified."

Senate to Vote Thursday on Appeals Court Nominee Who Said Judges Can Amend the Constitution with Judicial ‘Footnotes’

Hamilton, who would sit on the 7th Circuit Court of Appeals in Chicago if confirmed, has said his decisions as a federal judge can “amend” the U.S. Constitution by adding “footnotes” to it.

He told the audience: “Let’s start with the Constitution. Judge S. Hugh Dillin of this court has said that part of our job here as judges is to write a series of footnotes to the Constitution. We all do that every year in cases large and small.”

I have no inherent problem with that quote...what else would you call any interpretation of the constitution?

Republican senators, backed by conservative allies outside Congress, had blocked a vote for five months until Democrats overcame a filibuster Tuesday. Although 10 GOP senators joined the vote to end the filibuster, only one - Hamilton's home-state Republican, Sen. Richard G. Lugar - voted yesterday to confirm him. - AP

The games senators play. Nine GOP senators will now say they voted against Hamilton's confirmation, in the hope that most Americans are still too uninformed to know that the cloture vote, where ten of them voted for cloture, is the real vote that allowed Hamilton's confirmation.
