That would be a violation of 1st amendment rights. It’s one thing to sue to stop dissemination of “speech” you know exists, but to stop a category of speech that you *think* exists? don’t think it would fly.
On the other hand, I COULD see the tapes being obtained under subpoena by a government entity, under the guise of investigation, but in reality to sit on them.
Just my 2c worth, not a lawyer nor do I play one on teevee.
If Breitbart is smart and it appears that he is, he has copies hanging out there ready to go viral on the net from numerous sources.
