Sorry, but Sec Def has 0 authority the same as Holder does.

They both answer directly and ONLY to Dear Leader.

Might be grasping at straws and spinning wheels, but was wondering if maybe a NYC Congressman, such as Peter King, might have standing and he appears like someone who might try something like this???
