It amazes me. These people would have advocated serving a warrant on Hitler before commencing D-Day. Point being, criminal laws don’t apply to acts of war. The normal rules of war (Geneva Convention) don’t even apply to terrorism. The Geneva Convention is, basically, a hostage situation that was pre-bargained. It was not agreed to so as to benefit others but rather to protect our own. The problem is it presumes that the other side values their people as we do our own. When they strap bombs onto their own people it shows the total inapplicability of the Geneva Convention (aside from the stateless issue). Frankly, I wish Bush had sat down with Britain and our other terrorist allies and drafted a new convention on dealing with terrorists. I know, just shoot them, would have been the best result but it would have resulted in constant legal turmoil. If the laws and conventions had been clear on the matter then they could have just acted on it before Obama got his chance.
