Perhaps that is so ... but "treason" makes a statement and enforces the standard. Rather than sitting and waiting for the next jihadist in our midst to heed the call of a host of virgins, I'd prefer our boys felt comfortable "outing" him before the damage is done. Our leaders should make it clear that treasonous behavior will be exposed and treated as such ... in my opinion at least.

The murders would be easy, but they probably need more evidence for treason. However, if he sent money to pakistand and was sending e-mails to bin laden, then it seems they have some evidence in those regards.

His likely defense will be some sort of incapacity based on being brainwashed into Muslim extremism. Hell likely make your points to try to save his life. Theres no necessity to make motive a necessary element.
