The only way for Justice to assert jurisdiction is to say that Hasan was part of broader conspiracy - a conspiracy that would meet the guidelines set-forth in the anti-terrorism statutes stemming from the Oklahoma City bombing and 9/11. Holder's not going to do that, ever. The last thing his boss wants is for this to be tied directly to terrorism.
Nope, Hasan will most certainly be facing trial by court-martial under countless UCMJ specifications. It is also my guess that his defense team will craft some kind of affirmative defense to try and spare his life. But, he's not going to beat this rap and a plea of not-guilty would virtually guarantee a death sentence.
