Premeditated murder and treason are the natural perception of his criminal behavior. Worse than these criminal actions, he also has impugned the integrity of the office to which he had been sworn, casting doubt in the veracity of the command amongst his juniors.

Beyond the judgment of his criminal behavior, the command now must also convince and lead those junior to the authority of his office, that the command’s judgment is righteous and just. This means the leadership must win the hearts and minds of those who follow it, now that their trust has been tarnished.

WASHINGTON, March 4, 2011 – An Army official has recommended that Maj. Nidal M. Hasan be tried before a general court martial authorized to consider capital punishment, Fort Hood, Texas, officials said today.

Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5, 2009 attack on troops readying to deploy to Afghanistan.

The commander of the post’s 21st Air Cavalry Brigade, Col. Morgan Lamb, has recommended the charges pending against Hasan be sent to a general court martial authorized to consider capital punishment. The colonel’s recommendation is non-binding. The convening authority – in this case, 3rd Corps commander Army Lt. Gen. Robert W. Cone – will make the final decision in the Hasan case.

Officials at the post released the information after Hasan’s defense counsel publicly released the recommendation.

Army lawyers are reviewing the charges and the Article 32 investigation in order to provide legal advice on the case to Cone.

Fort Hood officials said in a news release that under the Uniform Code of Military Justice, a general court-martial convening authority has several options upon receipt of charges from a subordinate commander, including but not limited to dismissing the charges, referring them to court martial or sending them to a different convening authority for possible action.

Army Secretary John McHugh has ordered disciplinary action for nine unnamed officers in the Fort Hood shooting, according to NBC News. Although the Army’s investigation noted that “no single event” led to the massacre, “certain officers” in command of Major Nidal Hasan “failed to meet the high standards expected of them,” ignoring signs of his increasing radicalization.

Hasan currently faces the possibility of military court-martial for a shooting attack on Fort Hood on Nov. 5, 2009. Hasan is accused of murdering 13 people and wounding more than 30 others in the attack, before he was shot and paralyzed at the scene of the crime. The subsequent investigation showed signs of radicalization before the attack, including a presentation to fellow medical workers that outlined his religious motive for the attack.

The nine officers will face “non-judicial punishment,” a non-criminal sanction, and will remain anonymous because of their right to appeal. McHugh further ordered the Army surgeon general to review the Medical Command’s training and evaluation of medical officers. This follows reports that Hasan’s evaluations were inflated for promotion and to alleviate a shortage of military psychiatrists.

Major Hasan, also known as Soldier of Allah, according to his business card, mowed down thirteen U.S. soldiers while screaming Allahu akbar on the Fort Hood military base in Texas a year and a half ago, in November 2009. Yet his trial keeps on being postponed. On March 30, Lt. Gen. Robert Cone, the outgoing commanding general at Fort Hood, granted a request from John Galligan, Hasan’s lawyer, to delay the trial until late April. Galligan, however, disclaims responsibility for all the delays, blaming them on none other than Barack Hussein Obama.

Rick, a reader of my website, AtlasShrugs.com, forwarded to me an email exchange he had with Galligan. Rick wrote to Galligan last Thursday: “The American people are getting pretty upset about all of these delays.” On Friday, Galligan responded: “Delays are due to prosecution/White House refusal to disclose evidence. Blame them for the delays.”

So where is justice?”

Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5, 2009, attack on troops readying to deploy to Afghanistan.

Campbell, who also commands 3rd Corps and serves as a general court-martial convening authority, made the decision after considering all matters submitted by the defense counsel as well as the recommendations of Hasan’s chain of command, the Article 32 investigating officer and his own legal advisor, Fort Hood officials said.

The court-martial in the Hasan case is authorized to consider death as an authorized punishment.

An Article 32 hearing under the Uniform Code of Military Justice is similar to a civilian grand jury hearing.

After a case is referred to trial by court-martial, a military judge receives the case and eventually sets a schedule.

Hasan’s arraignment likely is the first matter for a military judge to schedule. A military judge has yet to be named to the case.

At a military arraignment, the judge discusses the rights of the accused, including the right to counsel, and makes sure the accused understands his rights. A military judge usually calls on the accused through counsel to make motions for relief and enter pleas, which may be deferred to a later date.
The Fort Hood public affairs office will announce the arraignment date and location after the authorizes its publication.

On November 5, 2009, Major Nidal Hasan, a U.S. Army psychiatrist who had previously served at the Walter Reed Army Medical Center, shot 45 of his fellow soldiers at the deployment center at Fort Hood in Texas, killing thirteen. It was the most deadly shooting attack ever on an American military base. Maj. Hasan, who had been scheduled to deploy to Afghanistan, was charged with murder and attempted murder, but not terrorism. His court-martial will begin next month. Meanwhile, Maj. Hasan continues to receive military pay, as well as free medical care and legal representation from the Army.

Immediately after the shootings, President Obama called Hasan’s actions “inexplicable” and suggested that he may have “cracked” under stress. The media followed suit, emphasizing the stress of treating soldiers emotionally scarred by war, and insinuating that Hasan had been unfairly picked on by his colleagues. One talking head said “we may never know if religion was a factor” in the killings. Another lamented that Hasan had failed to “reach out for help.” In reality, Hasan had long exhibited bizarre, menacing behavior that would have gotten him kicked out of the Army several times over if not for his protected status as a Muslim. The sympathetic disinformation was intended to hide Hasan’s actual purpose — to kill as many infidel American soldiers as possible for Allah.

Allowing the troops, or at least the officers, warrant officers and NCOs to carry firearms on post would have been a lot more help when the SHTF.
